By ordering a cake from Maxmama’s Bakes, you are agreeing to the following terms and conditions.
Our Cakes
-
Our cakes are freshly baked to order and hand decorated. There may be some slight decoration variations to cakes on our advertisements or to one of our previous creations.

We do not offer fondant covered cakes.
-
Our bespoke cakes are decorated with Swiss meringue buttercream or ganache. American buttercream can be specifically requested at the time of booking.
-
We offer selections of fresh cream cakes and cakes filled/decorated with cream cheese frosting. Storage information will be provided upon delivery/collection.

Ingredients & Allergies
-
Please note that all products are made in a kitchen that handles all allergens. Our products may and do contain any of the main 14 allergens including: PEANUTS, NUTS, CRUSTACEANS, MOLLUSCS, FISH, EGGS, MILK, CEREALS CONTAINING GLUTEN, SOYA, SESAME SEEDS, CELERY, MUSTARD, LUPIN AND SULPHUR DIOXIDE, due to processing.

If a severe allergy is known, it is the customer’s responsibility to inform that guest not to eat the cake due to the possibility of trace allergens.

It is the customer’s responsibility to make us aware of any special dietary requirements or allergies that need to be accommodated in the making of their cake. If we are unsure that we are unable to handle order with allergies, order may be denied.

We will not be held responsible for any allergic reactions that may occur after someone comes into contact with or after consuming any of our products regardless of the severity of this, including death.

Quotation
-
Quotes are valid for 7 days from the date of creation, if you choose to proceed with your booking after this period, the price may differ as prices are subject to change.

Orders
-
Orders will be accepted via e-mail, our website or Facebook page only.
-
Once your order is confirmed, you will be sent an order form detailing your order requests and an invoice. Following this, a booking fee must be paid within 48 hours to secure your order.
-
We prefer at least 31 days notice for all orders, as we are continually booked in advance. We will however endeavour, where availability permits accept short notice cakes.

Short notice orders must be paid in full at the time of booking.

Designs & Alterations
-
Inspiration pictures can be used as a reference. Customers’ bespoke requirements and amendments to the design will be discussed and approved by the customer during the order process.

Please note it is impossible for us to exactly copy a cake. A bespoke cake ordered from a picture of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture. There may be small differences in decorations, colours and finish.

We reserve the right to make minor changes to best suit a design if we feel it necessary, and these changes may not always be communicated to the customer.

Any alterations to the original order must be confirmed in writing and may be subject to an additional charge. Late amendments to orders are often possible and every effort will be made to accommodate changes, but cannot be guaranteed. Last date for any alternations is at least 31 days prior to the delivery/collection date. Changes to your order may result in an admin charge of a maximum of £15.

Payments

For custom cake – A booking fee of 25% is required at time of booking to secure the date for your order, without this we will not hold the date. The final balance is due 31 days before collection/delivery date, without this your cake will not be made. This booking fee is non-refundable.

For pre-designed cakes, crepe cakes and small bakes - Full payment is required at the time of booking to secure your order. All details will be set out in your confirmation.

We currently only accept payments via bank transfer, details of which will be provided upon booking.

Refunds & Cancellation
-
The booking fee of 25% in non-refundable due to time already spent on your consultation and any loss of business due to your booking preventing further bookings on that date. Your booking fee can be transferred to another date provided that a new date is available in our calendar.

If you have to cancel after your final payment date, we will apply cancellation charges as follows:

Cancellation can only be made by the person who placed the order, or another person authorised to act on their behalf, and is communicated to us in writing.
-
We retain the right to cancel the booking in unusual circumstances beyond our control, such as fire, power cut, ill-heath and etc., during which we will refund in full any money taken.

Fresh Flowers
-
We only source edible fresh flowers for cake decorations from our trusted suppliers. We do not source or provide inedible fresh flowers for cake decoration and take no responsibility if inedible fresh flowers are used on a cake.
-
If inedible fresh flowers are provided, customer acknowledges that inedible fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Certain inedible fresh flowers are not food safe and cannot be used on your cake. Customer should obtain a notice of plant safety from the florist.

Non-edible Items

Our cakes may contain non-edible ingredients or decorations. These include, but are not limited to: wire, dried spaghetti, plastic dowels, faux flowers, wooden picks, and other small non-edible products that could constitute a choking hazard. Please take care to remove these before consuming our products as we will not be held liable for any incidents or damages if non-edible items were accidentally consumed.

Such non-edible items will be detailed in our cake care instruction leaflet upon delivery/collection. Please take a moment to read this before consumption and ensure this information is relayed to the person cutting/serving the cake.

We cannot be held liable for any incidents caused by customers adding their own edible or non-edible decorations/ embellishments to our cakes following delivery/collection. Altering or adding to our cakes post-receipt, is entirely at customer’s own risk.

Collection
-
All orders may be collected free of charge from us by prior arrangement. We will not be held liable for any damage that is rendered to the cake once it has been collected.
-
Collection is in Norwich NR3 area and exact collection address will be sent to you 2 days prior to your collection date.
-
Upon collection, cakes should be transported on a flat surface (preferably in an empty boot or passenger footwell - dependant on size of cake/car!). We strongly advise against transporting cakes that are put on a seat or a passenger’s lap as the angle can cause damage to cake.
-
On hot days, it is recommended to travel with the air conditioning on or the windows open to keep the environment relatively cool, so that the cake does not get too warm which will result in melting/collapsing of the cake.
-
Some cakes may not be suitable for collection which can be discussed at the point of ordering.
-
Tiered cakes are most at risk during transport and every care should be taken by customer to ensure the cake is as safe and secure as possible during transit.
-
Any cakes not picked up within 1 hour of the agreed collection time will be held for a maximum of 24 hours. A new collection time (and day) will be arranged at our convenience.
-
Cakes not collected after this time may be destroyed. In which case, we reserve the right to seek 100% of the order value.

Delivery
-
Delivery charges are calculated on a mileage and time basis plus an admin fee. The cost of delivery will be made clear in the price quoted for your order. If the venue is changed and of further distance, additional charges may apply.
-
If you choose delivery, it is our intention that your cake will be delivered in perfect condition prior to the start of your event. However, we ask for patience with factors that may be beyond my control (e.g. accidents and traffic conditions) as we cannot be held liable for any such delays. For this reason, we recommend all cake orders are delivered at least 2 hours in advance of the event start time. It is your responsibility to ensure you inform us of the correct event time and location plus the postcode of the venue/premises. In the unlikely event of late delivery, the maximum compensation will be a refund of the delivery charge.

Please note that although extra care is taken during transportation, damage in transit may occur.

We will not be held liable for any damage that is rendered to the cake once it has been delivered.
-
Late requests for delivery (after securing the booking based on collection) will be accommodated where possible, but cannot be guaranteed.
-
Delivery charges will be fully refunded if customers choose to later collect instead.

Cake Storage
-
Fresh cream cakes and cakes decorated with cream cheese frosting
-
Fresh cream cakes and cream cheese frosted cakes must be refrigerated.
-
We advise fresh cream cakes to be consumed on the day of delivery/collection or must be consumed within 2-3 days.

Buttercream cakes
-
Buttercream cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat in the box provided.
-
Our buttercream cakes will stay fresh for up to 3 days after delivery/collection. We advise you to store leftover cake either in an airtight container or by covering the cut side of the cake with foil or clingfilm.

During a hot season, buttercream cakes may need to be refrigerated, cakes must be left outside of the fridge for a minimum of 1 hour to allow buttercream and sponges to come to room temperature before serving for optimal taste.

Please note that if your cake is decorated with fresh fruit and flowers, these will only last a day before they begin to weep or wilt.

Our cake is baked to ensure it is fresh for the date of your event. We cannot guarantee its quality if it is consumed more than 48 hours after delivery/collection. Our cakes are made entirely of natural ingredients, so we would like to remind you that because of this, they will not have the extended shelf life like most supermarket cakes, which contain additives & preservative.

Serving Portion

Number of servings per cake as detailed in quotes are a guideline only. Yield will vary dependent upon how the cake is cut, which is the responsibility of the customer. We cannot be held responsible for shortfalls in portions.

Complaints
-
Should you have concerns about your cake, please notify us immediately upon collection/delivery of the cake so that we have the opportunity to rectify it in time for your event.
-
Where the complaint is in regards to the quality of the cake then the cake, or remainder of the cake/tier of at least 75%, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.
-
All other concerns should be made in writing, and evidence of the fault should be included.

Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum, social media or website without providing advance written notice of the intended content thereof, and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

Please note that we can only deal with the customer who placed the original order.
-
Please understand that we cannot issue refunds for cakes that have already been completely eaten.
-
No refunds are given due to change of mind.
-
Quality determination and refunds are solely at the discretion of Maxmama’s Bakes.

General Terms
-
Prices are regularly reviewed and are at subject to change at any given time without prior notice.
-
All designs and intellectual property rights remain the property of Maxmama’s Bakes.
-
We reserve the right to use images of your cake for any form of advertising including social media, web-based promotions, brochures, galleries and competitions and this applies to any pictures sent to us as well.
-
We have the right to revise and amend these terms and conditions. However, you will be subject to the terms and conditions in force at the time that you place your order with us.
-
The parties agree to submit to the non-exclusive jurisdiction of the English courts.
